The General Terms and Conditions 

1. Scope of Application The General Terms and Conditions (T&C) apply to any membership and, where applicable, to the Yoganesa Card, the Private Card and Single and Private Classes at Yoganesa. By participating in a yoga class at Yoganesa, the Student agrees to the applicability of these General Terms and Conditions. Yoganesa may from time to time amend these General Terms and Conditions. The most recent version of the Terms and Conditions is always the version that is applicable and is always available on the Yoganesa website. Yoganesa will announce any amendments to the General Terms and Conditions in advance by e-mail. 2. Monthly Membership, 5 or 10 Classes Card, Single class, Try-out class and Private class. Yoganesa offers the following possibilities for taking yoga classes at Yoganesa:  

1. MEMBERSHIP

1. Membership entitles the member to 26 classes (1x week membership); 52 classes (2x week membership); an unlimited number of yoga classes (unlimited membership) during the term of the Membership. 2. The minimum Membership term for the monthly Membership is six (6) consecutive calendar months. 3. Cancellation of monthly Membership must be communicated to Yoganesa in writing on the fifteenth (15th) day of the last month at the latest. You can send an e-mail to info@yoganesa.nl. The annual Membership will expire automatically after the contract period. 4. After a minimum term of three (3) months, a student’s monthly Membership may be put on hold for one (1) month. This may be done by sending an e-mail to: info@yoganesa.nl before the 15th of the month prior to the month to be suspended. 5. A student’s Membership commences when Yoganesa has received the membership fee from the Student. 6. An annual Membership can be paused for a maximum of 2 times, for 1 month each maximum, during the twelve-month contract period  

2. YOGANESA TRY-OUT CLASS AND INTRODUCTION CARD 

1. The Yoganesa Try-out class entitles the holder to one class + one free class to use within 6 days. The Yoganesa Introduction Card entitles the holder to ten (10) Pilates/yoga classes and can be purchased only once, by students new to Yoganesa. 2. The Yoganesa Introduction Card is valid for thirty (30) days from the date of purchase. The 10 classes must therefore be attended within one (1) month of the date of purchase. After that period it is no longer valid and this right lapses.   

3. YOGANESA CARD 

1. The Yoganesa Card entitles the holder to five (5) Pilates/yoga classes and is valid for 6 weeks after the date of purchase. The Yoganesa Card entitles the holder to ten (10) Pilates/yoga classes and is valid for twelve (12) weeks after the date of purchase. After that period, this right lapses.  

4. PAYMENT AND PRICE CHANGE

1. All Pilates and yoga classes organised by Yoganesa must be paid for before the student may attend. Payments can be made by Debits, Cash, PIN and Transfer. 2. As a general rule, direct debits are made around the 30th of the month. If the amount cannot be collected, a handling fee of 25 euro is charged. In the case of non-payment, Yoganesa reserves the right to suspend the account of the relevant Student. 3. Yoganesa reserves the right to change prices. Any changes are announced in advance by putting up posters on the premises of Yoganesa, by placing statements on the website, and/or by email. The currently applicable rates are always mentioned on the website and are available for inspection at the reception desk of Yoganesa. 4. On presentation of an official student card or a student public transport pass, Yoganesa grants a 20% discount on all private and group Pilates and yoga classes at Yoganesa, except for the Introduction Card and Try-out classes. 5. Before a yoga class the Student must report to the reception desk of Yoganesa to check in.  

5. RESERVATION FOR PILATES OR YOGA CLASSES 

1. All classes are available for online/app booking 7 days in advance. You can book classes online, by phone, via app or at the reception desk. Your booking is valid until 5 minutes before the class starts. If you haven’t shown up by then, we assume you won’t be coming. Your space may go to someone else. 2. If booking online/via app is no longer possible, you can still come to the studio. We always keep 3 spaces available for walk-ins. The walk-in spots become available no sooner than 15 minutes before the class starts. 3. You can cancel your booking until 1 hour before the class starts. To do this, go to your online account and cancel the class in your schedule. 4. Please be on time, at least 10 minutes before class starts. This will insure your reserved spot, and you will also have enough time to prepare for your class.

6. SCHEDULE

1. The current schedule of classes and workshops is published on the Website. Yoganesa reserves the right to change the schedule at any time. If possible, any changes are announced in advance by putting up posters in the Yoganesa rooms, mentioning them on the Website, or by email. 2. Yoganesa reserves the right to cancel a yoga class that has been scheduled, or to change the yoga teacher mentioned in the schedule, in the event of force majeure, including illness of the teacher. In this case there will be no refund of any Membership fee. 3. Yoganesa is nearly always open but reserves the right to close its doors on public holidays or on other days.  

7. EARLY TERMINATION OF MEMBERSHIP, CLASSES CARDS IN CASE OF ILLNESS

1. In the event of prolonged illness or injury, the Student may terminate the Membership early. A request for early termination must be submitted to Yoganesa in writing and must be accompanied by a medical certificate. This termination may be sent by email to info@yoganesa.nl.  

8. LIABILITY

1. Attending Pilates, yoga, meditation classes, Workshops, Retreats and leaving belongings in the changing rooms are at the Student’s own risk. Yoganesa accepts no liability whatsoever for physical/mental injury, loss or damage relating to a Student’s attending Pilates, yoga, meditation or mindfulness classes, Workshops or Retreats; or leaving belongings in the changing rooms at Yoganesa. With regard to Yoganesa’s website and offering of video classes and courses: To the fullest extent permitted by applicable law, Yoganesa is not be liable for any loss or damages, directly or indirectly incurred, arising out of or in connection with your use of the website, following any programme or class including video classes or courses, and/or the information contained in them. All of this falls under the responsibility of the student. 2. Yoganesa works exclusively with certified yoga teachers and always ensures high-quality Pilates and yoga classes. Even so, a Student always runs the risk of being injured during a class. By participating in a Pilates and / or yoga class at Yoganesa, the Student accepts this risk of an injury. Yoganesa provides the following guidelines for reducing the risk of an injury: 3. Always consult a doctor before starting Pilates and yoga classes if you are not sure that you are completely healthy or if you are pregnant. 4. If you have an injury or any other physical hindrance, always inform your Pilates or yoga teacher before starting class. 5. Listen to and follow the instructions of your Pilates and yoga teacher. 6. Perform the Pilates and yoga exercises carefully and bear your physical limitations in mind. 7. Do not perform any Pilates and yoga exercises that are painful. 8. Ask questions if you do not understand an exercise. 9. Avoid inverted poses during menstruation. 10. Although we strive to provide only the correct information on our website, we are not liable for any inaccuracy and no rights can be derived therefrom.  

9. PERSONAL DATA:

1. Yoganesa collects personal data from its Students and Participants to update its membership records, to execute payment orders and for administration and information purposes. Yoganesa handles this collection of personal data with due care and complies with the provisions of the Dutch Data Protection Act. 2. Yoganesa uses the personal data referred to in Clause 9.1 to inform Students and Participants about activities of Yoganesa and any changes in the schedule, for example. If the Student does not want to receive communications from Yoganesa, he or she may communicate this by sending an e-mail to info@yoganesa.nl; or by changing their preferences by logging into their personal page on yoganesa.nl.  3. Yoganesa never gives any personal data of the Students or Participants to third parties without their prior written consent.  

10. GOVERNING LAW AND DISPUTE SETTLEMENT

1. The General Terms and Conditions are exclusively governed by Dutch law. 2. Any disputes relating to the General Terms and Conditions, any Membership, a Yoganesa Introduction Card, a Yoganesa Card, a Private Card or a Student’s attending group and private yoga classes, Workshops or Retreats organised by Yoganesa are settled exclusively by the relevant court in Rotterdam or any higher court.   

11. CODE OF CONDUCT

1. Students shall adhere to Yoganesa’s code of conduct at all times: 2. Please make sure you are clean and fresh when you attend Pilates and yoga classes. The use of unscented deodorant is highly appreciated. In view of potential allergies of other Students, everyone is asked not to wear any perfume, aromatherapy oils or other scented products, and not to use any spray deodorant in the changing rooms. 3. Wear clean yoga clothes in yoga classes, in which you can move easily. 4. Yoganesa advises that you eat not less than two hours before the start of any Pilates and yoga class and, in any case, not to do Pilates or yoga on a full stomach. 5. Please do not wear shoes in the yoga studios. 6. Yoganesa makes yoga mats available for use during yoga classes. After classes, a yoga mat must always be cleaned and put away by the Student who has used it. 7. The physical and mental integrity of Students must always be respected. Sexual behaviour or sexually suggestive behaviour is not tolerated by Yoganesa.   ADDITIONAL GENERAL TERMS AND CONDITIONS FOR WORKSHOPS AND TEACHER TRAININGS

12. PARTICIPATION IN WORKSHOPS AND REGISTRATION FEE

1. A Participant may participate in a Workshop or Retreat after he or she has registered for it with Yoganesa in advance and paid the fee. Register for a Workshop or Retreat by sending an email to info@yoganesa.nl. A place in the Workshop is guaranteed only after Yoganesa has received payment of the full fee or the Deposit, and providing there remains space in the workshop or retreat. 2. For some Workshops, an “Early Bird Rate” applies. This reduced rate applies until the date specified on the Website. After this date the normal rate, which is also specified on the Website, applies without exception.  

13. PAYMENTS AND PRICES:

1. The Price for a Workshop or Teacher Training can be found on the Yoganesa website.  2. Payments for a Workshop must be made before the Workshop is held. Payments can be made by direct debit, PIN, Cash or Transfer. A place in the Workshop is guaranteed after Yoganesa has received payment of the full fee or the Deposit.  

14. CANCELLATION OF WORKSHOP REGISTRATION

1. Any participation in a scheduled Workshop may be cancelled only in writing. Cancellations can be done by sending an e-mail to: info@yoganesa.nl. 2. Up until one (1) month before the scheduled Workshop date, the Participant may cancel his or her registration free of charge.  3. Up until two (2) weeks before the scheduled Workshop date, the Participant may cancel his or her registration, in which case the registration fee is refunded, minus a handling fee of 25 euro. 4. If the Participant cancels his or her registration less than two (2) weeks before the scheduled Workshop, the registration fee is not refunded.

15. RETURN POLICY PRODUCTS PURCHASED FROM YOGANESA

1. Any product purchased from Yoganesa, such as books, yoga mats, eye pillows, etc. can be returned within 14 days of purchase in the original packaging, and with the receipt.
